Acceptable Use Policy

This Acceptable Use Policy (“AUP”) forms part of the RIADVICE Terms of Use. It sets out what may and may not be done with the Services, so that they remain lawful, secure and available for everyone. It uses the definitions of the Terms of Use. By accepting the Terms of Use, including by completing an order, you accept this AUP.

1. Scope

This AUP applies to every Service and to every person who uses one, including the Customer’s Users and anyone who accesses a Service through the Customer’s account. The Customer is responsible for making sure that its Users comply with it. Product Terms may add rules for a specific product or platform.

2. Lawful use and freedom of expression

RIADVICE supports lawful free expression, teaching, research and debate. The Services may not, however, be used to host, share or distribute content, or to carry out activities, that are illegal under Tunisian law, under the law of the country where the Service is operated or under the law of the country where the User is located.

3. Prohibited content

You may not use the Services to store, publish, transmit or make available content that:

  • sexually exploits or endangers children, in any form;
  • promotes or incites terrorism, violence or hatred against people on the basis of their origin, religion, gender, sexual orientation, disability or any other protected characteristic;
  • is defamatory, harassing, threatening, abusive or invades another person’s privacy;
  • infringes copyright, trademarks or other intellectual property rights, including pirated software, media or unauthorised downloads;
  • is fraudulent or misleading, including scams, phishing pages and false offers;
  • contains malware, viruses, ransomware or other harmful code, except within a security research arrangement agreed in writing with RIADVICE;
  • discloses other people’s personal data without a lawful basis;
  • is otherwise unlawful, indecent or objectionable under applicable law.

Lawful adult content may be hosted only where RIADVICE has agreed to it in writing beforehand. RIADVICE may refuse to host it at its discretion, and it is never permitted on Public Platforms unless their own terms allow it.

4. Prohibited activities

  • Harassment: sending abusive or threatening material, or disrupting a meeting, class or community.
  • Fraud and impersonation: fraudulent schemes, scams, misleading offers, or pretending to be another person or organisation.
  • Unsolicited messages: sending unsolicited bulk or commercial email or messages, or messages that do not comply with applicable anti-spam law.
  • Unauthorised access: attempting to access accounts, systems, networks or data without authorisation, or circumventing authentication, security or licence controls.
  • Probing and scanning: scanning, probing or testing the vulnerability of any system or network, including RIADVICE’s, without written authorisation.
  • Disruption: interfering with or overloading the Services, other customers, hosts or networks, including through denial-of-service attacks.
  • Resource abuse: using the Services for cryptocurrency mining, open proxies or relays, or as infrastructure for other cloud or hosting services, without RIADVICE’s written agreement.
  • Bulk or automated accounts: creating accounts in bulk or by automated means, or abusing free tiers, trials, referral or promotion programmes.
  • Unauthorised resale: reselling, sublicensing or sharing access to the Services without RIADVICE’s written agreement.
  • Reverse engineering: decompiling or reverse engineering the Services or Software, except where an open-source licence or mandatory law allows it.

5. Meetings, recordings and personal data

  • Inform participants before recording a meeting or class, and obtain their consent where the law requires it.
  • Do not use recordings, transcripts, analytics or reports for purposes that participants were not informed of.
  • Share meeting links and access codes only with intended participants.
  • Process other people’s personal data only with a lawful basis and in accordance with applicable data protection law.

6. Email, mailing lists and messaging

Mailing lists, newsletters and messaging tools, including contact and mailing middleware operated by RIADVICE, may be used only to contact people who have agreed to receive the messages or whom you may lawfully contact. Every commercial message must identify the sender and offer a simple way to unsubscribe, and unsubscribe requests must be honoured promptly. Purchased, rented or harvested address lists may not be used.

7. Security testing and load testing

Security tests, penetration tests and load or stress tests may be carried out only against systems you own or are expressly authorised to test, and never against RIADVICE infrastructure or other customers’ services without RIADVICE’s prior written agreement. Load tests ordered from RIADVICE are carried out under the conditions in Section 14 of the Terms of Use.

8. Fair use of resources

Where a Service is offered without a fixed limit, or with limits shared between customers, usage must remain within what is reasonable for the subscribed plan. RIADVICE may limit bandwidth, storage, connections or processing that harm other customers or the stability of the Services, and will contact the Customer to agree a suitable plan.

9. Accounts and credentials

Protect your credentials and prevent unauthorised access to your account. Do not share login details. You are responsible for activities carried out through your account, including by others who use it.

10. Enforcement

RIADVICE may investigate suspected violations. Depending on the seriousness of a violation, RIADVICE may issue a warning, remove or disable content, limit or suspend the Services or a User’s access, or terminate the Services, as provided in the Terms of Use. Where there is an immediate risk to people, to the Services or to other customers, RIADVICE may act without prior notice and will inform the Customer as soon as possible. RIADVICE is not obliged to monitor content, and its decision not to act on a violation does not waive its right to act later.

11. Reporting violations

Report violations of this AUP, abuse originating from our network, or content you believe is unlawful to abuse@riadvice.tn. Please include the address or location of the content, a description of the issue, the date and time, and your contact details. Notices of intellectual property infringement should also identify the protected work and the right you hold or represent. RIADVICE may share a notice with the Customer concerned.

12. Cooperation with authorities

RIADVICE cooperates with competent authorities and, where the law allows, with affected third parties, to investigate suspected crimes or civil infringements involving the Services. RIADVICE discloses information only where the law requires or permits it.

13. Changes

RIADVICE may update this AUP. Updates take effect as provided in Section 27 of the Terms of Use.
